These Terms of Service ("Terms") govern your access to and use of our AI-powered teeth visualization platform (the "Service") provided by Re Smiled ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms.

By creating an account, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, including our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

2. User Accounts and Eligibility

  • Age Requirement: You must be at least 18 years old to use our Service.
  • Account Registration: You agree to provide accurate, current, and complete information during registration and keep your account information updated.
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.
  • Professional Use: If you are a dental professional, you represent that you have the necessary licenses and credentials to practice dentistry in your jurisdiction.

3. Use of the Service

License: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Service for your professional or personal use.

  • Generate realistic veneers simulations using artificial intelligence
  • Access credits and subscription-based features

4. Content Rights and Responsibilities

  • Your Content: You retain ownership of the images you upload ("Your Content"). By uploading, you grant us a limited, non-exclusive license to process, analyze, and generate veneers visualizations.
  • Generated Content: AI-generated veneers images are provided for visualization purposes only and do not constitute medical advice or treatment recommendations.
  • Prohibited Content: Do not upload images without proper authorization, copyrighted material, or content that violates privacy rights.

5. Credits and Subscription Terms

  • Credit System: Our Service operates on a credit-based system. Credits are consumed when generating AI veneers visualizations.
  • Subscriptions: Subscription plans automatically renew unless canceled before the billing period ends. Manage subscriptions in your account settings.
  • Payments: All fees are due immediately and processed through secure payment methods. Prices may change with 30 days notice.
  • Refunds: Credits and subscription fees are generally non-refundable, except as required by applicable law or our specific refund policy.

6. Acceptable Use Policy

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to reverse engineer, modify, or create derivative works of our AI algorithms
  • Upload malicious code, viruses, or attempt to gain unauthorized access
  • Share account credentials or transfer your account to others
  • Use automated tools to access the Service without permission
  • Violate any applicable laws, regulations, or professional codes of conduct

7. Intellectual Property

Our Service, including software, algorithms, design, and branding, is protected by intellectual property laws. You may not use our trademarks, logos, or proprietary technology without written permission.

8. Medical Disclaimer

Important: Our AI-generated veneers visualizations are for educational and planning purposes only. They do not constitute medical advice, diagnosis, or treatment recommendations. Always consult qualified dental professionals for treatment decisions.

9. Privacy and Data Protection

We handle your data according to our Privacy Policy. We implement appropriate security measures, but you acknowledge that no system is completely secure.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RE SMILED, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Termination

We may terminate your account at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the federal or state courts of California.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

These Terms constitute the entire agreement between you and Re Smiled regarding the Service and supersede all prior agreements.
